This Agreement (“Agreement”) outlines the terms and conditions of participation in the ‘Making with MASSO’ Competition (“Competition”) organised by Hind Technology Australia Pty Ltd (MASSO), located at 2/17 Memorial Avenue, Ingleburn, NSW 2565, Australia (“Company”).
By entering the Competition, participants (“Entrants”) agree to be bound by these terms and conditions.
Employees of the Company, their immediate family members, or individuals residing in the same household are not eligible to participate.
2.1 To enter the Competition, Entrants must submit a video that profiles the MASSO G3 or G3 Touch controller (the “Submission”) according to the guidelines set forth on the Competition website at masso.com.au.
2.2 Each Submission must meet the following requirements:
- Maximum video length: 20 minutes
- Title: Must include ‘MASSO G3 Touch Feature’ or similar
- Language: Any
- The Submission should highlight the features and benefits of the MASSO controller.
2.3 The Submission must be received by 30 April 2025 to be eligible.
3.1 The winner of the Competition (“Winner”) will receive the following prize:
- A MASSO G3 Touch Controller, delivered to the winner, freight and taxes paid valued at approximately $1,500 USD
3.2 The prize is non-transferable and cannot be exchanged for cash or any other form of compensation.
3.3 The Winner will be notified by email within 30 days of the selection. The Winner must respond within 14 days to claim the prize, or the prize may be forfeited.
4.1 All valid Submissions will be judged based on the following criteria:
- Creativity
- Adherence to product messaging
- Highlighting MASSO features and benefits
- Showcasing productivity improvements
- Visual and technical quality
4.2 The Winner will be selected by the Company on or about the end of May, 2025.
4.3 The Company’s decision is final and binding. No correspondence will be entered into.
5.1 By submitting a video to the Competition, Entrants grant the Company a worldwide, royalty- free, transferable, and irrevocable license to use, reproduce, distribute, and modify the Submission in any medium, including but not limited to digital, print, and social media, for marketing, promotional, or other business purposes.
5.2 This license is granted for the duration of the video content’s use by the Company, and will be perpetual.
5.3 Entrants represent and warrant that:
- The Submission is their original work and does not infringe upon any third-party rights.
- They have all necessary rights and permissions to grant the license provided in this Agreement.
- The Submission does not contain any defamatory, illegal, or otherwise inappropriate content.
6.1 Entrants retain ownership of the copyright to their Submission. However, by submitting the video, Entrants grant the Company the exclusive right to use the Submission as specified in this Agreement.
6.2 If necessary, the Winner will sign additional documentation confirming the transfer of rights to the Submission to the Company.
7.1 The Company will collect personal information from Entrants as part of the entry process. This information will be used solely for the purposes of administering the Competition and in accordance with the Company’s privacy policy, available at www.masso.com.au/privacy-policy/
7.2 By entering the Competition, Entrants consent to the collection and processing of their personal data for this purpose.
8.1 By entering the Competition, Entrants agree that their names, Submissions, and likenesses may be used by the Company for promotional purposes, including in social media, websites, and advertising, without further compensation or consent.
8.2 The Winner agrees to participate in reasonable publicity related to the Competition, including a winner’s announcement.
9.1 The Company is not responsible for any errors, omissions, or delays in the Competition process, including but not limited to technical issues with video submission, equipment failure, or late submissions.
9.2 To the extent permitted by law, the Company shall not be liable for any direct, indirect, or consequential damages resulting from participation in the Competition, or from the acceptance, possession, or use of the prize.
10.1 The Company reserves the right to modify or cancel the Competition at any time, for any reason, without liability.
10.2 If any provision of this Agreement is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
10.3 This Agreement shall be governed by and construed in accordance with the laws of New South Wales, Australia.
